The Legalities of “Going Green” – Debra Dyleski-Najjar, Esq.

  • When companies decide to “Go-Green,” they need to evaluate various legal issues which arise from electronic record keeping and electronic communications. What are the related laws and legal issues arising from e-records and e-communications in a green workplace.
  • Discussion will include: assessing data security risks; developing policies for compliance with state and federal data privacy laws; managing e-discovery in the event of litigation; obtaining valid employee consent to electronic agreements; obtaining valid electronic signatures on documents; and implications under ERISA for a green workplace.
  • Discussion also will address the importance of partnership among professionals in the human resources, compliance, marketing, and the legal departments to develop sound policies coupled with feasible data protection systems.
  • The growing importance of work place social media policies, how do we tackle the ethical and legal concerns, as well as the reputational risks to the company.

Earthquake in Japan, Epsilon/Sony Data Security Breaches; the impact on business continuity, lessons learned, and effects on global M&A activity. – Thomas Burke, SVP CIO

The disaster in Japan has business leaders and CIOs focusing on their own disaster recovery and business continuity plans. As businesses strive to manage through these challenging times, business continuity planning has become an increasingly important component of a global risk assessment framework, and has had a major impact on global M&A activity.
Discussion will include:

  • Lessons learned from recent events in Japan and Thailand
  • The challenges facing global technology leaders in planning for and implementing a robust DR and Business Continuity framework
  • How recent security breaches at organizations such as Sony and Epsilon have furthered the demand for enhanced data protection. Have we worked to consider how to deal with managing through the issues: How to estimate the damage, when to notify clients, should systems be taken off line (as Sony has done).
  • How these risks, when not properly assessed and mitigated, can affect the strategic direction of organizations (including increased M&A activity)

Debra Dyleski-Najjar, Esq. BIO:

Debra Dyleski-Najjar, Esq. is president and founder of the Najjar Employment Law Group, PC an AV-Rated labor, employment and benefits boutique firm. Ms. Najjar has practiced employment law for over twenty-five (25) years, and is a frequent author, lecturer, counselor, and trainer on workplace issues. She graduated third in her class from Boston University School of Law, and is a magna cum laude graduate of Wellesley College. She is admitted to practice in Massachusetts and New Hampshire. Ms. Najjar consults with and advises employers on a variety of employment law issues, conducts investigations into alleged harassment and misconduct, and drafts policies, procedures and handbooks. She also has extensive experience representing employers in litigation under ERISA as well as in defending other employment claims. Due to Ms. Najjar’s significant professional accomplishments, in 2007, she was nominated by her peers and inducted as a Fellow of the College of Labor and Employment Lawyers. She also has been recognized by Who’s Who for her many accomplishments. She is a member of the 2005 graduating class of Leadership New Hampshire, and has been recognized as a New England Super Lawyer each year since 2007, a recognition bestowed on only the top 5% of attorneys in New England. She also has earned credentialed status from the American Society of Pension Professionals and Actuaries. Ms. Najjar is a member of the Employment Law Section of the American Bar Association, and active in the ABA International Labor and Employment Law subcommittee. She also is a member of the Continuing Education Committee of the New Hampshire Bar Association (NHBA), moderator of the Annual Labor and Employment Update, and past chair of the Labor and Employment Law Committee. She serves on various non-profit boards.

Thomas Burke, SVP CIO BIO:

Thomas Burke is the Senior Vice President and Chief Information Officer for New York Life International (NYLI). Mr. Burke is responsible for the development and implementation of NYLI’s information technology program across all markets, including the strategic and tactical planning, development, evaluation and coordination of all information and technology systems. Prior to joining New York Life International, Mr. Burke served as Head of Operations and Technology at Citi Global Consumer Investments where he coordinated and implemented operational and technology solutions across 46 countries. Additionally, Mr. Burke was Head of Offshore Business Development, where he established an operational framework for conducting business across all the regional offshore businesses within the International Retail Bank. Before that, he held other positions within Citi’s Consumer Business including Head of Investment and Insurance Technology and Vice President Operations and Technology. Mr. Burke received a B.A. in Computer Science from Fordham University and an M.B.A. from St. John’s University, both in New York. Mr. Burke is based in New York Life International’s New York headquarters.
