- Current data security laws: what do we need to know??
- At least forty-three states, the District of Columbia, and Puerto Rico have enacted laws protecting personal data designed to protect consumers and employees from identity theft & financial fraud.
- The Red Flag laws & Health Insurance Portability and Accountability Act require covered employers to implement data security programs. Often, these laws require entities that collect or maintain personal information to contractually bind their service providers who have access to personal information, (i.e. third-party administrators, payroll companies and insurance agents), and to have these service providers certify that they have a compliant written information security program (WISP).
- Have you checked your WISP lately for compliance with the data security laws? Have you bound your service providers?
- Discussions on current and future overview of state and federal data security laws, best practices for auditing internal data security programs, and review of common causes of security breaches.
- Discussions on recent data security breaches including those arising from use of the web.
Neil Blumenthal’s Bio
Neil Blumenthal is a Co-Founder and Co-CEO of Warby Parker, a transformative lifestyle brand that offers designer eyewear at a revolutionary price, while leading the way for socially-conscious businesses.
Prior to launching Warby Parker in 2010, Neil served as Director of VisionSpring, a non-profit social enterprise that trains low-income women to start their own businesses selling affordable eyeglasses to individuals living on less than $4 per day in developing countries. He was responsible for developing VisionSpring’s award-winning strategy (Fast Company Social Capitalist Award ‘08, ‘07 and ‘05) and expanding VisionSpring’s global presence from one to 10 countries. In 2005, Neil was named a Fellow for Emerging Leaders in Public Service at NYU Robert F. Wagner School for Public Service.
In 2012, he was named a Young Global Leader by the World Economic Forum and one of the 100 Most Creative People in Business by Fast Company. In 2013, he received an Ernst & Young Entrepreneur of the Year award and was recognized as part of “The Next Establishment” by Vanity Fair and one of Crain’s “40 Under Forty”. Neil serves on the board of RxArt and on the United Nations Foundation Global Entrepreneurs Council.
A native of New York City, Neil received his BA from Tufts University and his MBA from The Wharton School of the University of Pennsylvania. Neil lives in Greenwich Village with his wife Rachel, the founder of Cricket’s Circle.
Debra Dyleski-Najjar’s Bio
Debra Dyleski-Najjar, Esq. is president and founder of the Najjar Employment Law Group, PC. She has practiced employment law for over thirty (30) years, and was an equity partner in a large regional law firm, with offices in Boston, Providence and Concord. In April, 2008, she founded the Najjar Employment Law Group, PC, a labor, employment and benefits boutique law firm designed to provide top quality advice, as well as litigation expertise, for employers at reasonable rates.
Due to Ms. Najjar’s significant professional accomplishments, in 2007, she was nominated by her peers and inducted as a Fellow of the College of Labor and Employment Lawyers. She also is a member of the 2005 graduating class of Leadership New Hampshire, and has been recognized as a New England Super Lawyer each year since 2007, a recognition bestowed on only the top 5% of attorneys in New England. She has extensive experience assisting employers in developing and implementing workplace data privacy and security programs under both state and federal privacy laws, as well as in negotiating business associate agreements when protected personal information is held by or shared with third party vendors outside the workplace.
Ms. Najjar is a magna cum laude graduate of Wellesley College, and a summa cum laude graduate of Boston University School of Law where she graduated third in her class and served as an Editor of the Law Review. She is admitted to practice in the state and federal courts of Massachusetts, New Hampshire, and Maine, as well as the First Circuit Court of Appeals and the U.S. Supreme Court. She also is a certified member of ASPPA. She is a frequent lecturer, and regularly advises companies concerning data security policies, best practices, and audits. She is a frequent lecturer.
